- Demolition of building 1,2,3 and 12 since 2010 i.e. around 230 tenements.
- No rehab building completed since 15 years. Only 13 floors external structure in newly constructed building having proposed sanction for 23 floors since 2010.
Reg: Dy. CM Eknath Shinde directions 17.6.2025 not to demolish the building 4 and 5 (copy attached)
- illegal demolition of building 4 and 5 renovated in 2023 with 15 crores i.e. Rs. 6450 repair cost per Sq. ft (when total actual construction cost as on today is Rs.2500 Sq.ft for new construction)
- eviction notice dt. 7.5.25 on ground of redevelopment (notice attached)
- eviction and demolition of new transit camp building A, B, C, D, E
In the above matter the working committee members consisting of several ladies and gents of this Gautam nagar visited my office today i.e. 6.8.25 at 10 pm with request to assist them to get justice and from not being harassed by the BMC officers to cause illegal eviction by force.
- As per the Maharashtra Govt GR dt. 13.1.25 (copy attached) every citizen can meet any public servant every day. I along with the affected parties shall be attending your office to discuss the issue as empowered by Article 51 A, of the constitution to safeguard the rights of the common man and to prevent any forcible eviction without reasonable grounds, thereby causing injury, hurt, and mental agony to around 120 families.
- The question raised here is if the building no. 1,2,3 and 12 demolished since 2010 have not been completed and the original occupants have not been rehabilitated. Now eviction notices are issued to a sound structurally good building for no valid reasons.
- Please provide the reasons and materials relied upon as well section and provision of law relied upon by Municipal Commissioner, Addl MC City, Addl MC project, DMC SWM and all others who have signed and / or permitted the issuance of eviction notices and to demolish the building with force to demolish the building 4, 5 and Transit camps A, B, C, D, E, WHICH ARE STABLE & in good condition on which 15 Crores have been spent just 18 months ago:
- with forceful eviction and demolition of building 1,2,3 and 14.
- The financial planning and amount set out to complete the project in from 2009 till today.
- Without issuing legal notice disclosing section, provision of law and reasons to demolish these building without providing the details of the redevelopment scheme namely
- Without entering into agreement for permanent accommodation disclosing the date of completing the building, the area of flat in Sq. ft., details of fungible area and other additional area as per law.
- Details of the amenities in the flat and basic infrastructure in the projects.
- Reasons for delay to complete the rehab building since 2010 and action taken against the contractor, architect and BMC officers who failed to complete
- Details of the amount spent on repairs of building 4 & 5 along with details of structural work carried out.
- Occupation certificate / completion certificate disclosing the increase of life span of building no. 4, 5 in the year 2023 or thereof.
- Name of the developer and architect who shall carry out the project and complete it.
- Details of SLP order relied upon to threaten the occupants and how this SLP order is applicable to this project.
- File noting, ATR and correspondence done after the direction dt. 17.6.2025 of Dy. CM Shri Eknath Shinde to not demolish the building 4 & 5 as prayed by the occupants.
- Inspection report, six monthly audit report, Structural audit report before demolition of all these buildings in Gautam nagar.
- Inspection Report relied upon disclosing that building 1,2,3 and 12 are in dangerous condition and beyond repairs and require demolition.
- Inspection Report relied upon disclosing that building 4, 5 and transit camp building A TO E are in dangerous condition and beyond repairs and require demolition
- Reasons and Copy of the study carried out to demolish the building 4, 5 and transit camp building A TO E which are in good condition without rehabilitating the occupants of building 1,2,3,12 for last 15 years.
- Details of each location along with and area of plot of land reserved / owned by BMC and public authority for SWM and for houses of workers.
- Present status of each of the above plots.
- Potential FSI permissible on each of these plots.
- Planning report disclosing how these FSI of public property shall be utilized.
- Total number of workers in SWM dept. doing conservancy work and are entitled for houses.
- Number of actual SWM conservancy workers who are allotted houses and the number of houses lying vacant
- Number of the SWM workers doing scavenging work not being allotted houses.
- Prayers
We request that till the above issues are solved and all information has been provided your office shall
- Stop eviction of building 4,5 and transit camps.
- Revoke all the eviction notices issued till today
Kindly note that the public authority shall provide the administrative reasons, study report and details of how the project shall benefit the sections of the society for which the project is reserved for. These plots cannot be used for any other purpose No other purpose. No sale building can be permitted, no FSI shall be sold. But used for public with ownership lying with public authority. No third part right can be created.

this is to inform you that no police protection can be given to evict the occupants of Gautam Nagar without replying to the satisfaction of the occupants who are denied their fundamental rights for peaceful living
The public servants shall first reply in writing to the queries raised in this letter
Any violation of fundamental rights of these citizens the Sr PI shall be personally liable on the grounds of denial of natural justice and without giving any opportunity to the under privileged class of society who keep the city clean and healthy.
Please educate me if my submission is incorrect
